ATLANTIC COUNTY

 

Bail Reduction

Attorneys may make an informal application for bail reduction by contacting the Bail Unit: at Criminal Case Management (609) 625-7000 x5446.  A letter of representation should be faxed to (609) 645-5875.  A bail report will be generated by the Bail Unit who will accept attorney submissions.  Bail reviews are completed within 24 hours of incarceration.  Bail reduction hearings are automatically conducted within 10-14 days after incarceration.

BURLINGTON COUNTY

 

Bail Reduction

Attorneys may contact the Bail Unit Office Joe Burns at (609)518-2582.  Information may be faxed to Officer Burn at Bail Unit for consideration.  The initial bail hearing is conducted via videotape on the first business day following arrest, generally in the afternoon.  The disposition is faxed to the Jail from the Court following the video appearance.  A defendant can be made available for an in-person initial bail hearing ½ hour prior to scheduled appearance if requested in writing.

Initial bail review is generally conducted within 48 hours of arrest.  Bail Unit can be contacted at (856)379-2200, extensions 3351, 3352, 3353, 3354, 3355, 3356, however, formal Bail Reduction Motions are generally required.  Motions must be filed by 3:00 p.m. on Friday to be heard the following Thursday.  Emergent Motions are handled pursuant to the Rules of the Court.

Farrell, J.S.C. and the Honorable John Waters, J.S.C.

Requirements:

The posting of property bail must be approved by the assignment judge, therefore it is recommended that sureties arrive as early in the business day as possible.  Must bring the deed to the property being posted, current mortgage statement showing the remaining balance, or the cancelled mortgage if paid off, a tax assessment, the market value of the unencumbered equity of the property as determined by an appraisal, proof that the taxes are not late or delinquent. If there are any equity loans on the property, a recent statement showing the balance must be provided. All owners must be present with valid identification. Equity must be the amount of bail plus $20,000 or greater. The property must be in New Jersey.

An $18 filing fee if the property is in Essex County, if the property is not in Essex County, the filing fee is $36.

Bail Reduction

Attorney may make informal request for bail by contacting Bail Unit at (973)795-5684 or (973)795-5687.  Initial bails on indictment charges are set at arrest or at the defendants CJP court appearance.  Review of those bails by a Superior Court Judge takes place the same day as the CJP appearance or the next day.  Prosecutor must be given 24 hour notice before a formal Bail Hearing is conducted.

Property being posted must be situated in New Jersey with an unencumbered equity equal to the amount of bail, plus $20,000.  The owner of the property being posted must file an affidavit containing:  a legal description of the property, a list of each encumbrance on the property, i.e., mortgage liens, etc., an appraisal conducted by a licensed appraiser by the State of New Jersey which shows the market value of the unencumbered equity of the property and a statement that the person or persons completing the affidavit are the owners of the property.  All the owners of the property must be present to sign the bond encumbering the property.  Tow forms of identification are required..

Bail reviews completed by Judge on a daily basis.  Informal applications for bail reduction are not accepted except under extreme circumstances.  Contact Criminal Case Management Bail Unit at (908) 806-4337.  Formal motions must be filed by Tuesday at 12:00 noon to be heard the following Monday.  Attorneys may file a Certification along with formal motion within 7 days of the Motion date.

Bail Reductions:

Attorney may make an informal application for bail hearing by contacting Barbara Baxter at (732)677-4544.  Bail reviews are automatically conducted 1-2 days after arrest, depending on when arrest occurred.  Judge Blum, J.S.C. presides Tuesday through Friday and hears bail motions at 10:30 a.m.  A Bail Review in lieu of a formal motion is automatically conducted by Judge DeStefano, J.S.C.  17 – 21 days after initial review.  These reviews are heard on Thursdays at 1:30 p.m.  Once the second bail review is conducted, a formal motion must be filed showing a change of circumstances.  Emergent Bail Motions may be filed in accordance with the N.J. Court Rules.

OCEAN COUNTY

 

Bail Reduction:

Attorneys may make an informal application for bail reduction by contacting Jay Mutter or Jeff Bell at (732)929-2042, ext. 2340.  Initial appearance occurs on the same day of arrest and is videotaped.  Informal bail review is done on the first available day after arrest and is attended by the Judge, Prosecutor and Mr. Mutter. Information or documents to be submitted for consideration during this review can be faxed, along with a letter of representation to (732)506-5067.  Formal Bail Hearings are heard on Fridays and each defendant is entitled to one such hearing a month unless otherwise ordered by the Court.

Property must be in the State of New Jersey.  No movable property.  All named owners must appear with 2 forms of photo identification.  Written proof from Municipality showing all taxes, water and sewer fees are paid to date.  Written proof from mortgage company, within 30 days, showing names of mortgagors, account number(s), address and amount due.  Equity must be greater than bail by $20,000.00 for 1st and 2nd degree crimes.  Equity must be greater than bail by $5,000.00 for 3rd and 4th degree crimes.  Written proof from homeowners insurer, within 90 days, that policy is paid to date (if paid by mortgage company, need written proof from mortgage company.)  Certified Property appraisal (be certified appraiser as opposed to realtor), including comparison photographs.  Title search conducted within 90 days with original signatures, which identify all lien holders and amount of lien.

PASSAIC COUNTY

 

Bail Reduction:

Bail reduction hearings are determined by the nature of the offense.  Attorneys should contact Jennifer Medica at (973)247-8338 for particular information pertaining to defendant.  For track A offenses, high impact crimes, a formal motion for Bail Reduction is generally required.  Bail is reviewed by a Superior Court Judge on the day of arrest.  The first Court appearance is held within the 72 hours of arrest.  Formal Bail Reduction Motions filed Monday through Thursday are heard on Friday unless filed on an emergent basis.  For Track B offenses, non-violent crimes, initial bail is set by the Municipal Court Judge within one day of the arrest.  Bail review is conducted by Superior Court Judge one week after it is set.  Pre-Indictment plea conference is generally held four weeks after arrest.

Original deed must be presented when there is no mortgage on subject property.  Property must be located in New Jersey.  Property can only be posted in cases of 1st or 2nd degree crimes and equity must be in excess of the bail amount by at least $20,000.  Must also present a certified appraisal, including comparison pictures, which must be done within one year of posting property for bail.  Must present current tax bill showing taxes paid to date.  A title search within the last 90 days is to be paid for by the applicant posting the property bail, showing no liens on the subject property.   A current statement within the last 30 days showing the mortgage company name, address, account number and balance must be presented.  The surety must provide letters from the municipal offices stating all taxes and municipal encumbrances are paid to date.  Homeowner must present a current (within the past 90 days) homeowner’s insurance policy or proof that payment has been made through the mortgage company.  All bails are held until the completion of probation/PTI regardless of the term.

Requirements include:  original recorded deed for the premises, Certification of an attorney that the title has been searched and is good from the date of the deed into the present owners, or from the date of the recorded first mortgage, including Superior and Federal District Court searches, (known as Trenton search).  A simple certified appraisal from a licensed New Jersey real estate broker reflecting the present market value of the premises.  A statement from any mortgages (banks, savings and loan associations, etc.) and/or lien holders of record stating the remaining balance due to the encumbrances.  Property owners’ equity must equal the amount of bail plus $20,000.00.  After execution and approval by the bail Judge of the property bond, the documentation is to be taken to the bail unit at the Union County Courthouse.  After the documents are copied, the bond is to be filed by the sheriff upon receipt of appropriate filing fees.  In order to post bail, all property owners of record must be present to sign the bail bonds.  No out-of-state property will be accepted.  Tax search and assessment search required.

Requirements:

Bail Recognizance Form must be completed.  In those circumstances when somebody other than the defendant (surety) is posting cash bail, the Affidavit of Ownership, located at the bottom of the Recognizance form must be completed in full.  Attorneys are prohibited from posting bail on behalf of their clients.  All cash bails over $10,000 will require the completion of an Internal Revenue Service Form 8300.

Requirements:

The property must have an unencumbered equity equal to the amount of bail undertaken plus $20,000.  The surety must present the deed on the subject property.  All persons listed on the deed must be present and provide (2) forms of identification.  If an individual on the deed is deceased, a certified copy of the death certificate must be presented.  A title search (within the last 30 days) showing all liens on the subject property is required.  If there is a mortgage on the said property, a current statement for each mortgage showing mortgage company name, address, account number, balance and that payment is current.  The surety must provide proof from the municipal offices stating all property taxes and municipal charges are paid to date.  A current home owner’s insurance policy showing the company name, address, account number and that payments and policy are current.  A certified appraisal showing the market value of the property as determined in a full appraisal with comparison pictures conducted in the last 6 months by an appraiser licensed by the State of NJ.  A lien on the property being posted as bail will be recorded with the Clerk of the County where the property is located.  Sureties will be required to provide proof of filing with County Clerks by presenting a receipt reflecting that recording fee was paid to the County Clerk.

$30.00 non-refundable filing fee is required.  Checks and money orders are to be made payable to the Treasurer, State of NJ.
