ACDL-NJ Vice President John C. Whipple just completed a seven (7) month trial in federal court, Trenton; the longest criminal environmental trial in the history of the Justice Department. John’s client, the Environmental Manager of a pipe foundry in Phillipsburg, New Jersey, was acquitted on all three counts he faced including a five object 18 U.S.C. § 371 conspiracy alleging: discharges of pollutants, violations of air permits, defrauding the United States, false statements to the EPA and obstruction of justice. The conspiracy count alleged 81 overt acts. The remaining counts charged a specific false statement to the EPA/DEP and a violation of the Clean Air Act. John was assisted at trial by ACDL-NJ member Mary Gibbons Whipple and investigator Richard Childs.
